
Alcohol Policy

1. Overview
Perk Infrastructure LLC ("Perk," "we," "us," or "our") operates a two-sided marketplace that connects users with local businesses, some of which serve or sell alcoholic beverages. This Alcohol Policy explains the roles and responsibilities of Perk, our business partners, and our users with respect to alcohol-related promotions, deals, and perks displayed on the Platform.
Perk is a technology platform only. We do not manufacture, distribute, sell, serve, or deliver alcoholic beverages. Any alcohol-related perks displayed on the Platform are offered and fulfilled solely by the participating business.
2. Age Requirement
You must be at least 21 years of age to view, save, or redeem any alcohol-related perk on the Platform. By accessing or attempting to redeem an alcohol-related perk, you represent and warrant that you are at least 21 years old.
Perk reserves the right to restrict access to alcohol-related content based on user age information provided during account registration. However, Perk does not independently verify a user's age at the point of redemption — that responsibility belongs to the business serving the alcohol (see Section 3).
3. Business Responsibility
Each business partner that offers alcohol-related perks through the Platform is solely responsible for:
- Age Verification: Verifying the age and legal eligibility of every customer before serving or selling alcoholic beverages, regardless of whether the transaction involves a Perk promotion
- Licensing: Maintaining a valid liquor license issued by the Michigan Liquor Control Commission (MLCC) or the applicable state or local licensing authority
- Compliance: Complying with all federal, state, and local laws and regulations governing the sale, service, and advertising of alcoholic beverages, including the Michigan Liquor Control Code (MCL 436.1101 et seq.)
- Responsible Service: Adhering to responsible service practices, including refusing service to visibly intoxicated individuals and minors
- Promotion Accuracy: Ensuring that all alcohol-related perks and promotions comply with applicable advertising regulations and do not encourage excessive or underage consumption
Business partners agree to indemnify and hold harmless Perk Infrastructure LLC from any claims, fines, penalties, liabilities, or damages arising from the business's sale, service, or promotion of alcoholic beverages, including any failure to verify age or comply with MLCC regulations or any other applicable law.
4. No Liability
PERK INFRASTRUCTURE LLC IS NOT A BAR, RESTAURANT, RETAILER, DISTRIBUTOR, OR SELLER OF ALCOHOLIC BEVERAGES. PERK DOES NOT SELL, SERVE, DELIVER, OR PROVIDE ALCOHOL IN ANY FORM. ALL ALCOHOL-RELATED PERKS AND PROMOTIONS ARE CREATED, MANAGED, AND FULFILLED EXCLUSIVELY BY INDEPENDENT BUSINESS PARTNERS.
TO THE FULLEST EXTENT PERMITTED BY LAW, PERK INFRASTRUCTURE LLC SHALL NOT BE LIABLE FOR ANY CLAIMS, DAMAGES, INJURIES, LOSSES, FINES, PENALTIES, OR LIABILITIES OF ANY KIND ARISING FROM OR RELATED TO: (A) THE SALE, SERVICE, OR CONSUMPTION OF ALCOHOLIC BEVERAGES AT ANY BUSINESS PARTNER LOCATION; (B) ANY BUSINESS PARTNER'S FAILURE TO VERIFY AGE OR COMPLY WITH APPLICABLE LIQUOR LAWS; (C) ANY INJURY, DEATH, OR PROPERTY DAMAGE CAUSED BY OR RELATED TO THE CONSUMPTION OF ALCOHOL; OR (D) ANY VIOLATION OF FEDERAL, STATE, OR LOCAL ALCOHOL REGULATIONS BY A BUSINESS PARTNER OR USER.
Perk's role is limited to displaying promotions on behalf of business partners. Perk has no control over, and assumes no responsibility for, the actions of business partners or users with respect to alcoholic beverages.
