DMCA Copyright Policy

1. Overview

Perk Infrastructure LLC ("Perk," "we," "us," or "our") respects the intellectual property rights of others and expects our users and business partners to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), we will respond promptly to claims of copyright infringement committed using the Perk platform (the "Platform").

If you believe that content on the Platform infringes your copyright, please follow the procedures outlined below to submit a takedown notice.

2. Filing a DMCA Takedown Notice

To file a DMCA takedown notice, you must provide a written communication to our Designated Agent (see Section 3) that includes the following information required by 17 U.S.C. § 512(c)(3):

  1. Identification of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that you claim is infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a URL or description of where the content appears on the Platform).
  3. Your contact information, including your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

3. Designated Agent

Note: We recommend that copyright owners register their DMCA designated agent with the U.S. Copyright Office at copyright.gov. Perk will update this section with our registered agent information once registration is complete.

4. Counter-Notice Process

If you believe that material you posted on the Platform was removed or access to it was disabled by mistake or misidentification, you may file a counter-notice with our Designated Agent. Your counter-notice must include:

  1. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside the United States, any judicial district in which Perk may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  4. Your physical or electronic signature.

Upon receiving a valid counter-notice, we will promptly forward it to the party who filed the original takedown notice. If the original complainant does not file a court action seeking to restrain the alleged infringer within 10 business days, we will restore the removed material.

Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability.

5. Repeat Infringers

In accordance with the DMCA and other applicable law, Perk has adopted a policy of terminating, in appropriate circumstances, the accounts of users or business partners who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Platform or terminate the accounts of any users or business partners who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
